Colombia won't accept settlement in Odebrecht lawsuit
The Colombian government will not seek to reach a settlement with Brazilian firm Odebrecht in a lawsuit brought by the company, in which the scandal-plagued firm seeks 3.6tn pesos (US$1.1bn) in reparations for the cancellation of the Ruta del Sol II highway contract in 2017.
The head of the Colombian state's legal defense agency (ANDJE), Camilo Gómez, told journalists that Odebrecht has until January or February to formally present the lawsuit, when the six-month period for a possible settlement expires.
"Colombia won't give up and there will be no conciliation," Gómez said on ANDJE´s Twitter account.
The official said that the government is also studying a ruling from last week that banned Odebrecht and its consortium partners in the Ruta del Sol II contract (Episol and CSS Constructores) from taking part in public contracts for 10 years and imposed a US$250mn fine on them.
In this regard, Gómez was quoted by El Tiempo as saying that the ruling "has arguments that will be used in the international arbitration process proposed by Odebrecht."
Back in August, Odebrecht said that the process does not seek "reparations", but rather an "acknowledgement" of its investments in the concession.
ANDRADE PROBE
Meanwhile, in one of the court cases surrounding the Ruta del Sol II contract, Colombian media reported that the former head of infrastructure agency ANI, Luis Andrade, who is being investigated over an addition to the same contract, has left the country despite awaiting trial.
Andrade's lawyer Jesús Albeiro, said that this client left Colombia for "personal issues" and due to security concerns, as he had previously claimed that he was being followed and that he was "concerned" over the death of a witness, RCN Radio reported.
In a separate press release, the country's migration agency said that Andrade left the country on Saturday and that there was no legal order preventing him from leaving Colombia.
Last week, the judge overseeing Andrade's case accepted a request from the defense that listed former president Juan Manuel Santos and other former authorities as witnesses in the upcoming trial.
