Uruguay TV operator wins key court decision in triple play plea
Uruguay's supreme court has ruled as unconstitutional the article in the law of audiovisual communication services that prohibits TV operators from providing telecom or data transfer services.
The ruling only applies to TV operator Monte Cablevideo, who filed a lawsuit demanding the right to use its available infrastructure to provide services. This would allow the operator to expand its offering by adding triple play to its portfolio.
A presidential decree from 2012 granted state-owned telco Antel the monopoly of cable internet services. Antel provides operators some access to its infrastructure so that they can have limited international interconnectivity. Uruguay has one of the fastest average internet connection speeds in Latin America.
DirecTV also filed a suit, and the supreme court concluded in April that the state monopoly on internet services for the residential segment safeguarded the interests of the general public and the right to access to information.
The court had a different view on the Monte Cablevideo case, stating that there are no valid reasons related to public interest that should limit this operator's ability to provide data transfer services.
Although the court's ruling only favors Monte Cablevideo for now, it is likely that other operators will file similar lawsuits.
