Court orders Chile to compensate Kodama over delays

A Santiago court ruled that the Chilean state must pay nearly 17bn pesos (US$27mn) to local construction firm Kodama over delays in the works for an express bus lane for Santiago's Transantiago mass transport system.

After a two-year trial, following annulment of an extrajudicial settlement between the firm and housing and urbanization service Serviu, a judge ruled that extraordinary works not mentioned in the original contract awarded in 2006 were required.

The judge also said that Serviu even forced interruptions to prevent negative effects on commerce, court documents show.

This prolonged the project, which involved the construction of a corridor in Santiago's Pedro Aguirre Cerda district, to 1,235 days from the 336 originally planned, causing additional costs to Kodama.

The project was criticized for the delays and was at the center of allegations of overpayments, though an investigation fell through in 2014 after the state desisted from pursuing a case against the company. The latest ruling can be appealed.
