Sabesp criticizes regulatory change in sanitation contracts
The head of São Paulo state water utility Sabesp, Brazil's largest sanitation company, criticized the federal government measure changing regulatory frameworks in sanitation contracts.
"We can't open the market by bringing an incentive that goes against the public interest," Sabesp president Karla Bertocco was quoted as saying by O Estado de S. Paulo newspaper.
Among other factors, the government measure will obligate municipal and state governments to consult private sector companies regarding their interest in service contracts and projects, and if there is interest, the local administration will have to open a tender process.
Previously, state-run water utilities had priority in winning contracts, while private sector companies could only compete for those that were not of interest to the state firms.
According to Bertocco, the measure can damage the ability of state-run companies to promote long term investments.
The measure has generated heavy criticism from opposition political parties and from local associations.
Earlier this month, the Brazilian government has extended for 60 days the effects of its provisional measure on sanitation projects, looking to garner additional support from legislators to approve the controversial issue. The government needs congressional approval by November 11, otherwise the measure will be suspended.
