OEFA imposes three new fines on Repsol for more than 22 million soles

The Environmental Assessment and Enforcement Agency (OEFA), an agency attached to the Ministry of the Environment, imposed three (3) new fines in the first instance for S/ 22,277,179.40 on Repsol's La Pampilla SAA Refinery, according to the following detail:

The first fine of 19,984 UIT, equivalent to S/ 91,926.40 , was imposed for not submitting the required information to the OEFA, given a situation of environmental damage, related to the environmental emergency that occurred on January 15, 2022.

The second fine of 4,000 UIT, equivalent to S/ 18,400,000.00, was imposed for non-compliance with an administrative measure referring to securing the area, carrying out containment, recovery and cleaning in the bay area of the Protected Natural Areas and in other affected marine areas, as a consequence of the environmental emergency of January 15, 2022.

The third fine of 823,025 UIT, equivalent to S/ 3,785,915.00, was imposed   in the event of non-compliance with an administrative measure related to securing the area, containing, recovering and cleaning up the oil spilled in the affected seawater; as well as, carry out the verification sampling of the water and sediments of polycyclic aromatic hydrocarbons (HAPs or PAH's) in the affected area as a result of the environmental emergency that occurred on January 24, 2022.

In this way, the OEFA has determined the administrative responsibility and, to date, has been imposing six (6) fines in the framework of the seven (7) disciplinary administrative procedures initiated against Repsol, of which three (3) are contested. before the Environmental Control Court and the other three (3) are within the legal term to file a challenge, which expire in January 2023.

The OEFA will continue to report on the environmental control actions carried out in relation to the oil spill in Ventanilla.
