Indigenous group takes El Morro case to Chile's supreme court

A group of Diaguita indigenous communities in northern Chile has filed an appeal with the country's supreme court to try to reverse a lower court decision that favored the El Morro project, a 70:30 JV between Canadian miners Goldcorp (TSX: G, NYSE: GG) and New Gold (TSX, NYSE MKT: NGD).

Last week the Copiapó court of appeals ruled unanimously against an injunction the communities had filed last November that sought to revoke El Morro's environmental resolution (RCA) that authorized construction of the US$3.9bn gold-copper project.

The opponents of El Morro claimed that the project's RCA was in violation of a number of rights, including the right of consultation with local communities under the International Labor Organization's convention 169.

In its appeal to the higher court, a group of 14 Diaguita communities claim they were excluded from the consultation process. The communities argue the Chilean state discriminated against them, as they were not properly or duly informed of the consultation process.

According to Lorenzo Soto, the lawyer representing the communities, the government issued the call to participate via the official gazette, but the communities do not have access to the publication, and therefore were not informed on time, local financial daily Diario Financiero reported.

Soto did not rule out the possibility of going to international courts, including the Inter-American Court of Human Rights in case the supreme court dismisses the appeal.

El Morro has proven and probable reserves in the order of 8.17Moz gold y 6.12Blb copper.
