Colombia's infra agency seeks to nullify Odebrecht contract
Colombia's national infrastructure agency (ANI) aims to nullify the contract for the Ruta del Sol 2 highway concession awarded to troubled Brazilian engineering and construction giant Odebrecht.
In a statement, the agency said it plans to request the nullification of the contract to the arbitration tribunal, "given the illicit acts that gave origin to it being awarded [to Odebrecht]."
The decision comes after the latest announcements from the office of the attorney general, which is investigating the reach of the bribes that Odebrecht paid across Latin America to secure multi-million dollar contracts.
In Colombia, the attorney general said on Monday that Gabriel García Morales, former deputy transport minister and then head of ANI's predecessor the National Concessions Institute (Inco), had accepted the charges filed by the attorney general related to the Ruta del Sol contract.
The attorney general's office charged García Morales on bribery, illicit enrichment and other charges. The former official allegedly received US$6.5mn to award the contract to Odebrecht.
On January 14, the attorney general arrested former senator Otto Bula, also on bribery charges related to securing the contract of the Ocaña-Gamarra highway in favor of Odebrecht. The firm is said to allegedly have paid Bula US$4.6mn.
ANI said that in addition to seeking to nullify the Ruta del Sol contract, it plans to conduct an independent audit related to the budget and financial model of the Ocaña-Gamarra highway, in order to properly identify any potential irregularities.
Governments across Latin America including Argentina, Peru, Ecuador and Panama have begun their own investigations into Odebrecht as information emerges from the massive corruption case in Brazil known as Lava Jato. Odebrecht's former CEO, Marcelo Odebrecht, was sentenced last March to 19 years in prison on charges of corruption and money laundering.
