Solway issues update on Guatemala mining operations

Solway Investment Group said production is continuing at its Fénix nickel mine in Guatemala pending clarifications on a court ruling.

The constitutional court ordered the suspension of the mine earlier this month until a retroactive consultation is completed under International Labour Organization’s (ILO) convention 169 rules, which relate to the rights of indigenous communities.

But Solway said the court’s decision has not yet come into force because the ministry of energy and mines (MEM) has sought clarifications.

“We expect the constitutional court to respond in due course,” the company said in a press release.

“In case of a confirmed suspension of our license, we will strive to keep the resulting staff layoffs to a minimum and will conduct these in full compliance with the applicable laws and regulations.”

Solway also expressed regret at last month’s state of siege announced in five municipalities in Guatemala, including El Estor, Izabal department, where Fénix is located.

The state of siege later failed to gain support in congress.
