US miner DynaResource secures Mexican injunction over mining concessions

DynaResource, based in Texas, reported that it obtained a favorable ruling from the Federal District Court in Mexico in the amparo lawsuit filed by its subsidiary DynaResource de México (DynaMéxico) regarding eight mining concessions of the San José de Gracia project in Sinaloa, which requires the authorities to restart the notification process before continuing with any administrative proceedings.

The court granted constitutional protection to the company, concluding that DynaResource "was not duly notified of the administrative proceedings that resulted in the alleged cancellation of the mining concessions published on the website of the Ministry of Economy, and that, as a result, it was denied its constitutional right to due process and the opportunity to defend its interests."

The court also ordered the authorities to "restart the notification process in accordance with the applicable legal requirements before proceeding with any administrative proceedings."

Rohan Hazelton, president and chief executive officer of DynaResource, said: "This ruling represents an important procedural milestone in the protection of the Company's legal rights in Mexico. While the judgment is not yet final and is subject to appeal by the relevant authorities, we are encouraged that the Court has recognized the Company's fundamental right to due process".

"We will continue to protect our interests while remaining focused on operational improvements and long-term value creation at San José de Gracia," he added. 

The company clarified that the ruling "is subject to the applicable appeal process under Mexican law, and the defendant authorities could request a review of the decision," and that together with its legal advisors it "will continue monitoring the process and will provide additional updates as relevant developments occur."

The injunction was filed on July 18, 2025 to protect the company’s rights in the face of a claim of inactivity regarding those concessions. Although the ruling “does not definitively resolve the underlying administrative matter,” the company explained, it “restores the Company’s procedural rights and requires the authorities to comply with the constitutional requirements of due process before any additional administrative action can be taken.”

The mining concessions covered by the ruling are San Sebastián, San José, Piedras de Lumbre Uno, Piedras de Lumbre Dos, La Nueva Esperanza and Nuevo Rosario, among others included in the company’s original statement.
